Victories for Our Clients
We have seen it all, but here are a few cases we recently resolved for our clients.
$100,000 Settlement
Our Client, K.W. was driving home from work in the East Bay when a car travelling the opposite direction attempted to turn left in front of her and into a bank parking lot. Our client t-boned the car, and her car, which was a souped-up Mustang with loud exhaust, and totaled it. Our client suffered a torn labrum in her shoulder that wasn’t diagnosed until 1 year later. The police report found our client to be at fault for speeding and driving recklessly because two independent witnesses said she was speeding and “revving her engine.” After filing a lawsuit and taking several depositions, we received the 15k policy limits from the other driver and received an additional 85k from her UIM (under-insured motorist) policy.
$52,500 Settlement
Our client, J.B., a passenger in her ex-boyfriend’s car, injured her neck after he pulled out into San Francisco traffic attempting to park and was hit. Client received conservative and alternative medical treatment, but suffered from lingering pain for many months. As a result of her injuries, the client, a business owner, also suffered financial losses to her business due to her inability to work, travel, etc. Making the claim difficult, her business showed increased revenues following her injuries. Prior to retaining our firm, the client attempted to represent herself in her insurance claim and was offered a take-it-or-leave offer of only $5,000.
$535,000 Settlement
Our client, R.M. was injured when the vehicle she was traveling in blew a tire (delamination) and rolled-over on a highway in Mexico on a hot summer day. She suffered severe injuries to one of her arms that was partially outside the window as the car rolled over. We sued the tire manufacture and a Bay Area vehicle-service company, who had given the vehicle its stamp of approval for the trip just days before they left for their road trip. After lengthy litigation, both defendants combined to offer a fair settlement.a business owner, also suffered financial losses to her business due to her inability to work, travel, etc. Making the claim difficult, her business showed increased revenues following her injuries. Prior to retaining our firm, the client attempted to represent herself in her insurance claim and was offered a take-it-or-leave offer of only $5,000.
$300,000 Settlement
Our client, J.G., a bicyclist, suffered severe injuries to his knee after a truck being driven by a City and County of San Francisco (CCSF) employee allegedly ran a stop sign in the Sunset District en route to a Muni delay that the employee intended to alleviate. We sued CCSF and through discovery we located and obtained GPS data that was being transmitted from the CCSF truck that tended to show that the truck did not stop at the stop sign as the driver testified in deposition, but rather only after striking Client. The case settled at mediation.
$45,000 Settlement
Our client, M.D., a bicyclist was riding home at night from the Outside Lands Festival in Golden Gate Park when a car that had turned into a driveway in front her ~100ft away unexpectedly reversed and reappeared in front of her. According to the driver’s testimony, he was readjusting to enter his narrow garage and he never saw our client until after the collision. Our client did not have a light on her bike, was not wearing a helmet, and may or may not have had a beer or two at the concert. The collision caused a 2.5 inch cut on her chin. The wound resulted in a subtle scar.
Confidential Policy Limits Settlement
Our client, T.D., a bicyclist was riding his bike home from work in Golden Gate Park when he was hit by a car in the middle of an intersection controlled by 4 stop signs. The collision caused our client’s jaw to be broken, which required his jaw to be wired shut for 2 months. There was a dispute about who had the right away and why the collision happened. The police determined that our client was at fault for failing to yield to the car. We disagreed, conducted our own investigation, and ultimately obtained the full auto policy from the driver.
$550,000 Settlement
Our client, B.C. suffered severe injuries after a car being driven by a lab technician pulled out in front of him at a two-way stop sign in Davis, CA as he left work for the day. Liability was clear and undisputed, however the driver had minimal insurance limits. As a result, we sued the driver’s employer alleging that his commute was covered by the company’s insurance policy despite the fact that employees are not typically covered during their commutes – citing Lobo v. Tamco, (2010) 182 Cal.App.4th 297, we alleged an exception existed because the company had come to rely upon the use of the driver’s personal vehicle. The case was vigorously defend by the employer throughout litigation, but after we defeated a summary judgment motion and trial approached, the employer relented and settled the case for a reasonable value.
$100,000 Settlement
Our client, V.D. collided with an automobile while traveling down Van Ness Avenue in San Francisco after a car turned left in front of him, thereby causing him to tear his PCL in his knee, which required surgery. Making the case difficult, the police report found our client to be at fault due to him speeding, and included a statement from our client in the report that he admitted he was going twice the speed limit – our client denied he ever said that to the officer. Despite the problematic police report and alleged negative statement against our client, we recovered the insurance policy limits for our client from the driver of the car.
$50,000 Settlement
Our client, J.P. was traveling east down Bush Street in the far right lane with the timed lights when a car suddenly ran the red light and pulled into his lane. The driver, a 20-year old Starbucks employee, was leaving work and was distracted by her phone looking for directions when she unknowingly rolled into the intersection and clipped our client’s bike, forcing him to lay it down at 40mph. She was driving daddy’s car. Client suffered an injured ankle and other minor injuries, but made a speedy recovery.
$175,000 Settlement
Our client, K.T., was crossing Market Street in a crosswalk, when a delivery truck turned right and struck her. She was jogging when she was struck. There was a dispute about whether K.T. still had the “green walk sign” and if she was legally crossing the street at the time she was hit. The collision caused her to suffer a broken right arm, which required surgery. Due to her broken arm, K.T. was not able to work as a physical therapist for 3 months and incurred substantial wage loss.
$50,000 Settlement
Our client, D.A., was walking to a bus stop at night after work in Benecia when he was hit by a car while crossing at a 4-way stop sign. There was no crosswalk at the intersection, although he was wearing a reflector vest and had a thermos with a flashing light on it. The collision caused him to suffer a torn labrum in his hip, although it was not diagnosed for over 6 months. Complicating matters further, D.A had a fall due to sudden cramping in his hip 7 months after the initial accident and tore his meniscus in his knee. We attributed both the torn labrum in his hip and the torn meniscus in his knee to his pedestrian accident. We were required to file a lawsuit, but after depositions we persuaded the insurance company for the driver to offer their policy limits.
$145,000 Settlement
Our client, H.F., was walking to work in Daly City when she slipped in hydraulic fluid that was left in a crosswalk after a street-sweeper crossed in front of her. H.F. thought the liquid was water from the street-sweeper. The fall caused her to tear her meniscus in her knee and she required surgery. We filed a lawsuit and determined that the street-sweeper had a hydraulic leak. H.F. claimed that knee still gave her trouble in daily life, however the Defendant hired a private investigator to film her and captured her running up and down stairs and otherwise looking spry and nimble. Despite this, we still were able to secure a favorable settlement.
$300,000 Settlement
Our client, J.G., a bicyclist, was injured at a four-way stop sign in the Sunset District when a utility truck being driven by a MUNI supervisor, en route to alleviate a rail blockage on the N-Judah line, crashed into him. We alleged that the MUNI employee ran the stop sign, while the City Attorney (City and County of San Francisco (CCSF)) alleged that J. G. ran the stop sign. During the lawsuit, we were able to obtain GPS data that was being transmitted from the truck that tended to show, although not conclusive, that the MUNI employee did in fact run the stop sign.
$55,000 Settlement
Our client, J.S., was walking home in Pacific Heights when he stumbled and fell after stepping into a poorly repaired portion of concrete near a utility box . The drop from the sidewalk into the portion of the concrete that was in disrepair was approximately 2 inches. The fall caused J.S. to fall onto his outstretched arm, which caused a small fracture in his elbow. He did not require surgery, but he did miss about 3 months of work as a physical therapist. Through the Sunshine Act, we were able to obtain correspondence between the property owner and the City, which showed that CCSF was on notice of the dangerous condition. The case settled without the need to file a complaint.
$660,000 Settlement
Our clients, N.B. and T.C., were the daughters of an elderly man that was killed while exiting a MUNI bus in San Francisco. The man was wearing a long rain jacket that was caught in the door after the driver did not allow the man enough time to exit the bus. After being dragged a short distance, the man was run over by the bus and ultimately died from his injuries several weeks later.
Confidential Settlement
Our client, S.L., brought a wrongful death claim after her mother died from a fall at her nursing home in Livermore, CA. Her mother required assistance when ambulating and general care from her caregivers. One day, S.L.’s mother was being taken out into the backyard of the nursing home for some fresh air when the caregiver left her standing alone on the patio to go answer the phone. S.L.’s mother fell, broke her hip and was hospitalized for 2 months before ultimately dying from complications. We sued the nursing home for negligence and obtained a confidential settlement for S.L.
$660,000 Settlement
Our clients, N.B. and T.C., brought a wrongful death claim for the untimely death of their 90 year-old father after he was killed by being run over by a MUNI bus as he attempted to get off the bus. N.B. and T.C.’s father was moving slowly and the bus driver closed the back door prematurely, causing his rain coat to become caught in the door. He was dragged a short distance, run over by the back wheels and died in the hospital 3 weeks later from his injuries. We obtained a settlement from the City and County of San Francisco for their emotional distress.
Confidential Policy Limits Settlement
Our client, B.H., hired us to represent her and her two children after her husband and father of her children died in a car accident in Oakland. The decedent was the primary bread-winner for the family. We sued the driver of the vehicle and the company that he was working for at the time of the accident. After rejecting several settlement offers and conducting substantial litigation, we settled the wrongful death claim for the insurance policy limits several months before trial.
